If my 3ds has an issue with the sound (it crackles on the left side when its to loud) will it be recorded with the captureboard with or without a crackling sound on the video?

That sounds like its a problem with the speaker on your 3ds. The capture audio supposedly comes from the motherboard and has nothing to do with your speakers. In short, it should capture without the crackling as long as it's just a problem with the speaker, and not the way the 3ds interprets the sound.
